TUNEZIES
Participation Agreement & Liability Waiver
Music, movement, and making memories. Before joining us, we ask all families to review the following agreement, which outlines important information about participation, safety, caregiver responsibilities, and liability.
This agreement applies to Tunezies classes, concerts, pop-ups, private groups, and other Tunezies experiences.
PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS CERTAIN LEGAL RIGHTS OF THE SIGNING ADULT.
1. Acknowledgment and Assumption of Risk
Tunezies LLC (“Tunezies”) offers interactive music experiences for children and families, including classes, concerts, birthday parties, private groups, school programs, and special events.
Activities may include singing, dancing, movement, musical instruments, rhythm sticks, shakers, scarves, ribbons, parachutes, bubbles, and other age-appropriate props and equipment.
I understand that participation in these activities involves inherent risks, including slips, trips, falls, collisions, minor injuries, allergic reactions, and other unexpected incidents.
I acknowledge these risks and voluntarily choose to participate in Tunezies activities with my child or children. I understand that Tunezies takes reasonable precautions to promote a safe and welcoming environment but cannot eliminate every risk associated with participation.
This acknowledgment does not waive any legal rights belonging to my child or children.
2. Parent & Caregiver Responsibilities
Tunezies is an interactive music experience, not a childcare or drop-off program.
For caregiver-attended classes, concerts, private groups, birthday parties, and special events, each child must be accompanied by a responsible adult who remains present and actively supervises the child throughout the experience.
Parents and caregivers are responsible for monitoring their children's participation, helping them use instruments and props appropriately, and following reasonable safety instructions provided by Tunezies staff.
Children should not be left unattended during Tunezies activities. Parents and caregivers are encouraged to communicate any concerns or accommodations that may help their child participate safely and comfortably.
For programs conducted within schools or childcare facilities, supervision responsibilities will be determined by the applicable arrangements between Tunezies and the participating institution.
3. Health, Illness & Accommodations
To help keep our Tunezies community healthy, parents and caregivers agree not to bring children to Tunezies activities when they have a fever, vomiting, diarrhea, or symptoms of a potentially contagious illness, or when they are subject to applicable school or public health exclusion guidelines.
Parents and caregivers are responsible for determining whether they and their children are well enough to participate safely.
Families are encouraged to inform Tunezies in advance of any allergies, medical considerations, sensory sensitivities, accessibility needs, or accommodations that may affect participation. Tunezies will make reasonable efforts to support individual needs and create an inclusive environment.
Parents and caregivers understand that Tunezies is not a medical provider and that participation may involve incidental exposure to other children, shared instruments, props, and common surfaces.
4. Emergency Procedures & Medical Assistance
In the event of an injury, illness, or other emergency during a Tunezies activity, Tunezies staff may contact emergency services and take reasonable steps to seek appropriate assistance.
Parents and caregivers remain responsible for their children's medical needs and for providing accurate emergency contact information during registration.
If a parent or legal guardian cannot be reached, I authorize Tunezies to contact emergency medical services and share information reasonably necessary to assist emergency responders.
I understand that Tunezies staff are not acting as medical professionals and that any medical evaluation or treatment will be provided by qualified emergency responders or healthcare providers.
Nothing in this section releases Tunezies from liability for its own legally actionable conduct.
5. Release of Certain Adult Claims
PLEASE READ CAREFULLY. THIS SECTION AFFECTS CERTAIN LEGAL RIGHTS OF THE SIGNING ADULT.
In consideration of my participation in Tunezies activities, I, on my own behalf and not on behalf of any minor child, voluntarily release Tunezies LLC and its owners, employees, instructors, and representatives from claims for personal injury, property damage, or other losses suffered by me arising from my participation in Tunezies activities, including claims based on ordinary negligence, to the extent such a release is permitted by Michigan law.
This release does not apply to gross negligence, reckless or intentional misconduct, or any claim that cannot lawfully be released.
Nothing in this agreement waives, releases, or limits any legal claim or right belonging to my child or any other minor. I am signing this provision solely in my individual capacity.
6. Responsible Conduct & Property Damage
Tunezies is committed to providing a safe, welcoming, and respectful environment for all participating children, families, instructors, and venue partners.
Parents and caregivers agree to follow reasonable safety instructions and help their children use musical instruments, props, and equipment as intended.
Families are expected to treat other participants, staff, instruments, equipment, and venue property with care and respect.
Parents and caregivers agree to notify Tunezies staff promptly if equipment is damaged or a safety concern arises.
Participants may be held responsible for property damage caused by their own intentional misconduct or negligence, to the extent permitted by applicable law. Ordinary wear and tear associated with age-appropriate participation is not considered damage for purposes of this agreement.
7. Photography, Video & Media Preferences
Tunezies occasionally photographs and records classes, concerts, and other experiences for educational, artistic, and promotional purposes, including use on its website, social media, and other digital or printed materials.
Tunezies will make reasonable efforts to honor each family's selected preference and communicate those preferences to photographers, videographers, and other authorized team members.
Families may request a change to their media preferences by contacting Tunezies in writing. Changes will apply to future uses where reasonably practicable but may not affect materials already distributed or published.
Participation in Tunezies does not require consent to promotional photography or video. Media consent is separate from the liability provisions of this agreement.
8. Registration, Payment & Cancellation Policies
Registration for Tunezies programs is subject to the pricing, scheduling, enrollment requirements, and policies communicated at the time of booking.
Payment is required to secure enrollment unless otherwise agreed upon in writing.
Sibling Registration: Each participating child must be registered and included in the total enrollment. Sibling discounts, when offered, will be communicated at the time of registration. Providing a sibling's information does not constitute paid enrollment; applicable sibling tuition must be included in the registration payment.
Six-Week Class Series: All registrations are final, and tuition is nonrefundable, including when a family cancels before the session begins. Missed classes cannot be made up, credited, or transferred.
Six-week class series require a minimum enrollment of 10 children. If Tunezies cancels an entire series, families will receive a full tuition refund. If Tunezies cancels an individual class, families will be offered a makeup class or a proportionate refund for that class.
Other Programs: Concerts, pop-ups, birthday parties, private events, and school programs may have separate booking and cancellation terms, which will be communicated at the time of booking.
Nothing in this agreement limits rights or refunds required by applicable law.
9. Safety Rules & Participation
Tunezies is committed to creating a safe, inclusive, and welcoming environment where children and their grown-ups can experience the joy of music together.
Participants and accompanying adults agree to follow reasonable safety instructions provided by Tunezies staff and participating venues.
Tunezies reserves the right to pause or modify an activity, request caregiver assistance, or discontinue an individual's participation when reasonably necessary to address a safety concern or conduct that substantially disrupts the experience of others.
Whenever practicable, Tunezies will communicate concerns with the accompanying adult and seek a reasonable solution before asking a family to leave.
Participation decisions will be made in accordance with applicable law, including applicable disability and nondiscrimination requirements.
10. Personal Belongings
Parents, caregivers, and participants are encouraged to keep track of their personal belongings, including strollers, bags, clothing, toys, and other items brought to Tunezies activities.
Tunezies does not provide secure storage for personal belongings and is not responsible for loss, theft, or damage except to the extent resulting from conduct for which Tunezies is legally responsible.
Families are encouraged to leave valuable or unnecessary items at home.
11. Governing Law & Severability
This agreement shall be governed by and interpreted in accordance with the laws of the State of Michigan, without regard to its conflict-of-law principles.
If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent permitted by applicable law.
Nothing in this agreement is intended to waive or restrict any rights or protections that cannot lawfully be waived.
12. Parent/Guardian Acknowledgment & Electronic Acceptance
By electronically accepting this agreement during registration, I acknowledge and confirm that:
I am at least 18 years old and am the parent or legal guardian of the child or children being registered, or I am otherwise legally authorized to complete their registration.
I have read and understand this Participation Agreement & Liability Waiver, including the acknowledgment of risks, caregiver responsibilities, and release of certain claims belonging to me personally.
I understand that the liability release applies only to my own legally releasable claims and does not waive or limit any rights or claims belonging to a minor child.
I agree to comply with the applicable registration, payment, and participation policies.
I understand that my separately selected photography and video preferences will be respected in accordance with Section 7.
I understand that my electronic acknowledgment and typed full name, submitted during registration, are intended to serve as my electronic signature and evidence of my agreement to these terms.
